Former Florida governor Jeb Bush, moving closer to a possible presidential run, has stepped down as a paid adviser to a for-profit education company that sells online courses to public university students in exchange for a share of their tuition payments. While many of our friends are up in arms on Maulana Abdul Aziz’s disgusting comments for which he must show regret and profusely apologize few have read the piece written in New York Times by Dr. Ayesha Siddiqa’s article in which she, in more careful language, explained the series of cause and effect, that this happened because Pakistan has not taken action against all groups like Hafiz Saeed & Others. (logic is defective too)

However, Ken Roth of Human Right Watch, tweeted a very unfortunate comment, while commenting on the Dr. Ayesha’s article, which is exactly the same which the likes of Maulana Aziz are saying. So this tendency to say that you deserved this – children being killed at point blank – for such and such reasons is not limited to primitive minded Islamists but our liberals and western global elite suffer from same mental attitude and set of prejudices though from the opposite direction ie in their perceived interest.

On human level they are little better than primitive Islamists. I did not retweet for it would look as if I am agreeing with him but I did comment that this amounts to same when many people after 9/11 had said that “US deserved it for its foreign policy”. You should go to Ken Roth’s twitter handle and express your disgust and displeasure at his highly insensitive comments. But expose his and Human Right Watch’s hypocrisy without being abusive. Since the Peshawar tragedy…!

Since the Peshawar Tragedy – Terrorism Attack on the Army Public School – I have not written anything here. Just a few tweets about Death Penalty that were produced here. I have remained very confused, in my efforts to make sense of what is happening. I know after years of studying this phenomenon that all TTP groups of proxies of one kind or another. Proxies are controlled in an intricate Wheel within Wheel type of mechanism. Foot soldiers – the kind of suicide fidayeen that attacked APS in Peshawar – are mere zombies of this conflict.

To defeat these “primitive warriors with modern weapons” we need to have a comprehensive strategy, which is principally going to be a war strategy but that does not mean that we will start challenging and fighting against all kinds of medieval Islamist groups or sectarian outfits all across the country.

These zombies don’t know what they are doing; they are indoctrinated in a way that they lose control over their bodies, they have no minds of their own and they have no will. We can hate them or call them as animals but they were mere human drones. But the complexity of this issue runs deeper beyond this; even the handlers who send them would not know who really wanted this kind of attack and what was the real objective. Was it just revenge against Army action? or the real planners wanted to achieve many things – aik teer say kain shikar – ??

Many things have happened since then; Pakistani politics has changed altogether, regional dynamics are changing; Is this what the planners of this “dastardly attack” wanted? Do these primitive warriors wanted a shocked and enraged nation and a military machine molten hot with anger to be chasing them? I feel the debate which has ensued since the tragedy is, as usual, happening at a very limited superficial level. We are again moving in the circles.

To defeat these “primitive warriors with modern weapons” we need to have a comprehensive strategy, which is principally going to be a war strategy but that does not mean that we will start challenging and fighting against all kinds of medieval Islamist groups or sectarian outfits all across the country. That will be a disaster of huge proportions. If we want to succeed then we need to ask ourselves: who did it? Why? Was purpose only revenge or the goal was also to influence Pakistani politics and regional dynamics? Armed with these questions we can hit back with military force, precision targeting and diplomacy; we can ignore these questions only at our peril. Hating “brain dead remote controlled zombies” and filling newspaper and tv space with such hatred is no solution.

We are not going to discuss history; historical facts and a small documentary will provide the background, but in interactive session with audience we will raise questions as to what our top politicians, state institutions and judiciary have learnt from the tragic failures that culminated in the Fall of Dacca and break-up of Pakistan. Then our decision makers were not prepared to concede on Sheikh Mujib’s Six Points, today they refuse Election Audit by hiding behind articles of constitution. Then we were against provincial autonomy and loose federation, now we are resisting the creation of new provinces and local governments. Facts of history are left behind, what matters is understanding. So what have we learnt?

Pak-Afghan improved relations but Modi Govt upset

Modi Govt upset about growing Pak-Afghan thaw & improved relations between Islamabad and Kabul and its intelligence apparatus may plan something in the region to divert attention and to bring Islamabad under pressure internationally and to isolate it..???

This looks like intelligence leaks to Pakistani media, which is also being discussed in news bulletins; so far the details are sketchy. It looks like based on intelligence intercepts; it is being speculated that this may take the form of attacks at strategic places inside India. All of this has a background which needs to be understood.

Any such happening will be frightening since Modi govt has already demonstrated its intent of a “hard line policy” towards Pakistan. Its escalation of border tensions at LOC, its retching of war of words, cancellation of Secretary level talks and rebuffing of peace overtures by Nawaz Sharif are all troubling signs. Add to this the internal political overtures of Modi govt like the commitment to abrogate Art. 370 which guarantees a Special Status to Jammu & Kashmir within the Indian constitutional framework and you clearly see that Modi govt is bent upon changing the rules of business or dealings with Pakistan. You can sense this “belligerent feeling” by hawkish comments of many of our Indian members on this page.

Pak-Afghan thaw then becomes the last straw on the Indian Establishment’s strategic apple cart. Delhi has patiently invested in building a strategic partner in Kabul. They have invested hundreds of millions of dollars and their commitments are around $ 2 Billion. India was one lone country that had consistently opposed total US withdrawal from Afghanistan. It feared that a US scale down will create space for Pakistani entry and maneuvering. New Delhi’s strategic calculus relies upon Afghanistan as an important ally to keep Pakistan under pressure from both sides.

With change of guard in Kabul, with Ashraf Ghani and Abdullah Abdullah both striking good chords with Islamabad, with Pakistani military flushing out TTP from North Waziristan, with Gen. Raheel Sharif and his new Intel Chief, Rizwan Akhtar increasingly successful in assuring Kabul of their neutrality in the internal power dynamics of Afghanistan and with the US seeing Pakistani military as a vital ally in keeping ISIS influence out of Pakistan and Afghanistan (notice Gen. Raheel Sharif’s statement in Washington), Indian strategic calculus is in serious jeopardy. New Delhi is upset and understandably so.

Even with a Congress govt they would have done something to influence these recent unfavorable developments – but with a belligerent trigger happy Modi government that already wanted to change “rules of business” these unfavorable regional developments may be quite difficult to digest. Fear is that they will do something to redress this “changing balance”. Pakistani media is discussing it, but Pakistani Foreign Office should address these concerns in its briefings. It should air its concerns on such news and assure New Delhi that it will extend its fullest cooperation in the event of any third party doing any irresponsible act in the region. Word should go out internationally that something can happen and all sides need to be alert and vigilant to address and cooperate in any such eventuality.

Why Imran and PTI should compromise on resignation of PM Nawaz?

Why Imran & PTI should compromise on Resignation of PM Nawaz in lieu of a genuinely empowered Judicial Commission backed by a Joint Investigation Team with ISI & MI as components?

Because the real progress in Pakistani democratic history will take place when a genuinely powerful Judicial Commission will be able to investigate the rigging, deliberate wrong doings and executive and policy failures that marred the Election 2013 which without any doubt has been the most controversial and hotly disputed election since 1977. An Election that has jeopardized the future of democracy in Pakistan.

the Election Tribunals worked like Session Courts on the Pakistani convention of Adversarial Trials where both sides (who challenge each other) have to bring accusations and then evidence to back it up.

If you are watching the debate on tv screens, you will realize that all parties and their “hired guns” afraid of a genuine free fair and transparent election under a reformed restructured Election Commission are trying to sabotage the whole concept of the Judicial Commission. All kinds of funny and ridiculous excuses are being given for instance that this will be involvement of Army into politics. Surprisingly none of these johnnies protested when PMLN invited military under Art: 245 into Islamabad under the phony excuse of terrorism; then PM forced Army Chief to mediate into a political confrontation and sent ISI and MI officers to sit in negotiations. Now these “hired guns” are crying for using Election Tribunals. In our recent programs we were able to highlight that why Election Tribunals are meaningless to investigate the kind of systematic rigging that was done in Elections 2013. Following are some key points:

One, the Election Tribunals worked like Session Courts on the Pakistani convention of Adversarial Trials where both sides (who challenge each other) have to bring accusations and then evidence to back it up. Tribunals then got caught in technical matters as pointed out by the lawyer that most petitions were thrown out for not meeting the requirements of Sec 55(3) of the Representation of Public Act 1976 (ROPA) leading to a situation where facts are never investigated since every step of the work of the Tribunals gets stuck into Technical and procedural issues. This brings us to the first important point that Judicial Commission under Supreme Court should be fully empowered to act as an Inquisitorial Court like the French and Swiss Model where Judges can ask all kinds of questions, frame queries and then direct the Executive/Investigative Agencies to collect facts, all kind of facts and evidence to help the court understand the situation.

Second, this analysis itself helps understand that why Judicial Commission will be meaningless without the support of a powerful “Joint Investigative Team” consisting of Police, IB, ISI and MI. The last two agencies are the only two agencies who have real capacity of collecting and processing all kinds of information and are not under the control of any provincial party that fought elections.

Third, the single most important step which the Judicial Commission has to take is to order the Election Commission of Pakistan to place all Form-14’s (Statements of Count) around 70,000 in case of National Assembly Elections on its website. Why website? because Election Monitors, Political Parties and Media who are in possession of the thousands of such Form-14’s issued on 11th May 2013 can then compare and check if the Form-14’s ECP used to compile election results match with the Form-14’s being issued by the Presiding Officers in the evening of 11th May 2013. This comparison alone will furnish massive evidence to raise questions about the workings and transparency of the Election 2013. In case of differences Judicial Commission can order verification of ‘thumb impressions’ of Presiding Officers on Form-14’s. Specimens of thumb impressions of the Presiding Officers officially designated by ECP to work on 11th May 2013 are available in NADRA and AGPR. These two steps will answer most of the questions; opening way for larger investigation of why Election 2013 went horribly wrong.

Fourth, the deal between Nawaz Govt and PTI should be that govt agrees to create such a powerful independent Inquisitorial Commission supported by a JIT with ISI and MI technical support and PTI agrees to withdraw the demand of the resignation of PM Nawaz Sharif even on the conclusion of such investigations. Sword of resignation dangling on head of Prime Minister & PMLN makes it practically impossible to clear the way for political transition towards a transparent, fair next Elections in 2015.

Instead Judicial Commission should focus on finding the nature of rigging and irregularities, should suggest ways and means to improve the system, recommend the structure of a new reformed Election Commission which should be empowered on the pattern of the Indian Election Commission that takes over administration before the Election doing away the drama of this fake Interim Govt which in Pakistan is only used to do rigging under the excuse that we were not running the government and poor Najam Sethi was the Chief Minister of Punjab and so on. For all practical purposes PMLN was running Punjab, PPP interior Sindh and MQM Karachi before the May Elections in 2013 and all managed to collect as many votes as they needed.

this analysis itself helps understand that why Judicial Commission will be meaningless without the support of a powerful “Joint Investigative Team” consisting of Police, IB, ISI and MI.

Judicial Commission can’nt and should not recommend the resignation of PM Nawaz Sharif and Imran Khan should compromise on this demand in lieu for getting a genuinely empowered Commission backed by JIT supported by MI and ISI.

Commission once it finds the rigging and irregularities and their scope may recommend an “Early Elections” either in the beginning of 2015 or end of 2015; and political parties can settle amongst themselves the addition of opposition like PTI and PPP into central and provincial governments (Cabinets) to increase transparency before the these elections. But the single most important step at that stage will be the creation of a new Election Commission in which process should be more important than personalities.

This whole debate about who will head the Election Commission is meaningless, [an energetic civil servant in his fifties should head it instead of octogenarian judges] what is important is the internal balance of power between its various organs and total transparency so that all political parties, media, election monitors and civil society organizations can continuously examine what is happening inside the Election Commission. Multan Bye-Elections is a good example of how massive rigging becomes impossible when media and monitors are watching each step and bureaucracies are less inclined to help politicians rig the election.

Dunya News Application to NADRA & Punjab Police Response on our discussion & Questions: – Highest sources in Punjab Police contacted me after today’s discussion on Dunya News at 4pm News Bulletin in which I participated along with Dunya Bureau Chief Kamran who had filed our application to NADRA this morning to request identity of the “Shooter on the Video” and top Police Official explained in detail Police’s ongoing investigations and complex issues Police faces in Faisalabad Tragedy (Death of PTI worker Haq Nawaz & other injured).

Police asserts that this is a highly politicized case which makes them very cautious before they say something and they are investigating from all angles and are hopeful that “Shooter on Video” will also be arrested soon. Police sources says that they had their own cameras in the area and they have lots of footage of the crime scene but they have not seen evidence of other shooters except the one on Dunya News Footage.

Police asserts that this is a highly politicized case which makes them very cautious before they say something and they are investigating from all angles and are hopeful that “Shooter on Video” will also be arrested soon.

To my question that why not arrest those nominated in FIR? Police explains that it is not possible for them to arrest people only on the basis of nomination in the FIR. They point out that issue is very politicized – like all criminal issues during the recent political agitation – and there is a trend that both sides nominate the top leadership of their opponents in the FIRs. They ask: can they now arrest Imran Khan just on the basis of PMLN people nominating him in their FIRs? Police needs to ascertain and come to a reasonable basis for arresting someone when issues are so clearly politicized.

I have asserted to top officials that Faisalabad Police’s inability to conduct Operational Briefings and the fact that Politicians of the Ruling Party are conducting Press Briefings is creating all kinds of doubts and suspicions. Top Police Officials promised that an operational briefing with detailed facts will be done for media soon. Let’s hope that we get some certified checked facts soon.

From Model Town to Gujranwala: PMLN on road to violence?

From Model Town to Gujranwala to Jehlum to Multan, PMLN has cleverly relied upon tactical violence to brow beat its opponents; so far it has worked for them because they end up frightening the general public thus reducing the sizes of rallies and marches; it was fear of violence by govt that reduced the sizes of rallies in Islamabad since common people and families which are against the PMLN govt still try to stay away from zones of violence. This pattern seems to be repeated again in Faislabad today and needs to be understood.

Violence is being repeatedly used as a tool to terrorize the public which otherwise will turn out in very large numbers to protest and score its point. Govt is afraid of the TV cameras & helicams capturing large crowds so cleverly uses tactical violence. (Remember beatings of media, ban on helicams, huge advertisements as sweetners etc)Use of privateers becoming important because Punjab Police is increasingly less willing to do violence for govt.

Now you will see the spin from govt spokespersons to shift the blame for violence on PTI. Goal is to frighten the opposition and to create a legitimate excuse for broad police action to clear the streets. This strategy needs to be understood.
